It’s happened before (Bush v. Gore in 2000), and it could happen again, with the far-right SCOTUS waiting to hear a GOP-led lawsuit that could restrict the counting of mail-in ballots.2 It’s even more striking that Clarence Thomas and Samuel Alito could have a major impact on the 2024 election given their connections to January 6. Alexandria Ocasio-Cortez launched an impeachment inquiry against Thomas and Alito because of the justices’ raft of ethics violations and refusal to recuse themselves in cases where they had clear conflicts of interest, like the Trump immunity case. Thomas’s wife, Ginni Thomas, was involved in efforts to overturn the 2020 election.3 Alito’s connections to January 6 include a Stop the Steal style flag flying over his house4 and teaching a law seminar with a fringe election denier just days after the insurrection.5 No court should decide an election, especially not a court with justices steeped in ethics violations, corruption, and right-wing extremism. Congress must act now and remove Thomas and Alito.
