Oh the irony! Friend, Robert F. Kennedy, Jr's campaign just sent out an email with the subject line "RFK Jr. Censored by CNN." It's ironic because Kennedy tried to censor Daily Kos and our community with a lawsuit. Kennedy is whining that he didn't qualify for the upcoming presidential debate. Meanwhile, Kennedy's campaign failed to [meet the criteria]( for the debate: receive at least 15% support in four national polls of registered or likely voters and appear on the ballot in enough states to win the Electoral College. Kennedy whined that ["the exclusion is undemocratic, un-American, and cowardly."]( Cowardly? I'd call [suing Daily Kos]( to expose the identity of a community member who posted a critical story about his dalliance with neo-Nazis at a Berlin rally cowardly. [Fighting a lawsuit against a wealthy anti-vaxxer like Robert F. Kennedy Jr. is expensive. Which Daily Kos has been doing for years and across numerous states. Now we have a chance to make him pay. This has become a critical free speech case, one that seeks to enshrine those rights for anonymous online speech in New York. We also want lawyer fees for their unconstitutional assault on our First Amendment rights. Last month, in a unanimous decision slapping down Kennedy, a four-judge New York Supreme Court appellate panel ordered the case to continue, keeping the free speech issue alive and allowing us to proceed in seeking damages based on New York’s anti-SLAPP law, which prohibits “strategic lawsuits against public participation.” As one of our lawyers said: “A New York appeals court is unanimously allowing Daily Kos to proceed on claims that RFK Jr. had no right to try to unmask one of our users and that his attempts to do so violated New York's anti-SLAPP rules, which may entitle the site to seek damages against him.” It is important to Daily Kos that we win. Kennedy wanted us to doxx one of our community members, we stridently refused, and we won. We protect our community at all costs. Now Kennedy has to pay.
