STATEMENT: Supreme Court Kneecaps Government Power To Protect the Public Today, June 28, the U.S. Supreme Court overturned the 40-year-old Chevron doctrine, which has required courts to defer to a federal agency’s reasonable interpretation of ambiguous laws. In response, [Patrick Gaspard]( president and CEO of the Center for American Progress, issued the following statement: An extreme right-wing majority just empowered MAGA judges across the country to stop any effort by public agencies to protect Americans from workplace abuses, unmitigated pollution, and unsafe food and medicine. This court—beholden to self-interested billionaires and corporations—has decided that it, not Congress or the president, gets to make federal policy. The American people have lost as the wealthy will get to maximize their profits. It’s time for Congress to push back and restore reason to the court by passing a law to reverse this decision and to put in place 18-year term limits for justices who have run amok. [Read Patrick's Statement]( STATEMENT: Supreme Court Undermines January 6 Prosecutions Earlier today, the U.S. Supreme Court ruled that a federal law making it a crime to corruptly obstruct congressional inquiries and investigations cannot be used to prosecute participants in the January 6, 2021, attack on the U.S. Capitol. The case also could result in some related charges being dropped against former President Donald Trump. In response, [Devon Ombres]( senior director for Courts and Legal Policy at CAP, issued the following statement: The Supreme Court just made it harder to prosecute hundreds of insurrectionists, even though it was clear under the law and to all Americans that they wanted to obstruct Congress’ certification of Joe Biden’s victory. Justices Clarence Thomas and Samuel Alito have made it clear in their personal conduct whose side they are on in the fight to preserve American democracy. But it’s jarring to see that other justices joined them in this decision. A single justice who stays on the Supreme Court for decades can personally shape federal law for generations. No one individual should have that much power. Enacting 18-year term limits is a key step toward restoring accountability, safeguarding the court's critical role for democracy, and protecting the interests of everyday Americans. [Take Action]( STATEMENT: Supreme Court Dismisses Case Without Making a Decision on Emergency Abortion Care Just yesterday, the U.S. Supreme Court addressed the procedural mess it made in Idaho v. United States, during which vulnerable pregnant patients bore the consequences of the politicization of the judiciary. Although emergency abortion care under the Emergency Medical Treatment and Labor Act (EMTALA) will be permitted in Idaho while the merits of the case are decided by lower courts, pregnant patients and medical providers will continue to be caught in the crosshairs. In response, [Sabrina Talukder]( director of the Women’s Initiative at the Center for American Progress, [issued the following statement]( Pregnant women in dire medical emergencies bore the life-threatening consequences of the Supreme Court’s procedural “[miscalculations]( during the litigation of Idaho v. United States. And although the Supreme Court’s action today provides some degree of relief that medical providers in Idaho can do their job without fear of criminal sanctions, Justice Samuel Alito’s dissenting opinion reveals how extremist justices remain willing to commandeer the judiciary to effectuate their personal anti-abortion ideologies and politicize medicine. Idaho v. United States will go down in history as a case where the Supreme Court’s premature interference into ongoing litigation highlighted how the politicization of the judiciary fuels the politicization of medicine, with pregnant patients bearing the consequences of a delay or outright denial of urgently needed medical care. To date, Head Start programs have served nearly [40 million children]( from low-income families across cities and rural communities in America. Despite its impact, far-right extremists have developed a plan to eliminate Head Start as detailed in the authoritarian playbook dubbed “[Project 2025.]( This plan would significantly restrict the number of available child care slots, increase child care costs for families living in poverty, undermine economic growth, and exacerbate inequality. On average, the national price for child care in 2023 was $11,582, which accounts for 38.6 percent of the income of families at the poverty line, which is the income eligibility threshold for Head Start. Eliminating Head Start would not only harm children who are able to access emotional, social, health, nutritional, and educational support through the program, but it would also jeopardize opportunities for parents and caretakers who rely on Head Start’s free child care services to seek employment and educational opportunities that further stabilize their families. To eliminate this crucial lifeline for families in need would have a devastating ripple effect across the country, depriving the most vulnerable children and their families of opportunities to nurture their healthy development.
